Couple Charged With Daughter's Murder

The parents of 3-year-old Edith Gonzalez, the severely malnourished Brooklyn girl who died last month of child abuse, have been indicted on murder charges by a state grand jury, officials said.
The Brooklyn grand jury indicted Patricia Aguirre, 24, and Edison Gonzalez, 27, with second-degree murder, second-degree manslaughter and criminally negligent homicide, according to a spokesman for Brooklyn District Attorney Charles Hynes.
They face maximum penalties of 25 years to life in prison for the murder charge, which alleges a homicide by depraved indifference to human life, said spokesman Jerry Schmetterer.
The couple was also indicted on charges of endangering the welfare of a child, the original charge for which they were being held, said the spokesman.
When she died Aug. 26, Edith was 2 feet, 10 and ½ inches tall, weighed only 23 pounds and had a number of old bruises and a skull fracture, officials said last month. The city medical examiner ruled that her death resulted from child abuse syndrome.
In court papers filed in August, investigators alleged that Aguirre, also known as Tania Cabrera, said that she did not seek medical attention for Edith because she feared child welfare authorities would remove her son, Javier Aguirre, 4, from the home.
Gonzalez told police that he and Aguirre withheld food from Edith as a form of punishment, court papers stated. Gonzalez also said he had struck the child with his hand, as had Aguirre, according to the papers.
Edith had only been in the country from Ecuador for about a week when she was taken to New York University Medical Center in a coma. Javier Aguirre is being cared for by the Administration for Children's Services.
Both Aguirre and Gonzalez are being held without bail on the earlier charges. The next court appearance is expected in about two weeks in Brooklyn criminal court when they will be arraigned on the indictment.
