Exclusions. Applied will have no obligation to supply any Maintenance Services in connection with any Error or other problem arising from or related to: (a) the misuse, improper use, alteration, or damage to the Covered Software following delivery by Applied to Customer; (b) modifications or alterations to the Covered Software not made by Applied; (c) the combination of the Covered Software with other software programs or programming code not provided by Applied; (e) any version of the Covered Software other than the most current Release, if such Error would be corrected by installation of the most current Release; or (f) the procurement, installation, or maintenance (or lack thereof) of any equipment, telephone lines, communications interfaces, and other hardware necessary to operate the Covered Software. Any services outside the scope of the Maintenance Services expressly defined in this Agreement will be subject to the separate mutual agreement of the Parties, subject to Applied’s standard professional services terms and rates. In addition, Applied reserves the right to charge additional service fees if Customer’s personnel repeatedly seek assistance with respect to (i) basic information that can be found in the Documentation; or (ii) matters not directly related to the operation of the Covered Software itself.
